Wrongful death claims are similar to personal injury cases in that they are derived from another's negligent actions, however in this instance said neglect act results in death. These actions are generally brought by the immediate family or heirs of the deceased. Unlike personal injury cases a wrongful death suit is created by Kansas statutory law and recovery of damages is limited by the provisions of those statutes.
